RKR Seadmed OÜ Terms of Use and Privacy Policy
1. Scope and Validity of Terms
1.1. These Terms of Use and Privacy Policy (hereinafter referred to as the Terms) apply to the purchase of goods sold in the online store of RKR Seadmed OÜ (hereinafter referred to as RKR), registry code 11733527, address Suur-Sõjamäe 29a, Tallinn 11415, by the customer (hereinafter referred to as the Client).
1.2. The parties shall be guided in their mutual relations by these Terms, the RKR price list, and the applicable laws of the Republic of Estonia.
2. Conclusion of the Contract
2.1. The sales contract for the ordered goods is considered concluded after the Client has placed the order and RKR has sent an order confirmation.
3. Prices of Goods and Services
3.1. The prices displayed next to the goods are in euros and show both the price excluding VAT and including VAT.
3.2. RKR reserves the right to make corrections to the prices of goods by updating the prices on the website.
3.3. If a product has no price or is listed at €0, the exact price is missing from the database. In such cases, please contact us by phone or email to confirm the price. If a consumer purchases a product that was not actually available, had an incorrect price due to a technical error or employee mistake, or the seller did not intend to sell it at the listed price, the seller has the right to cancel the order (according to TsÜS § 92 lg 3 p 2).
3.4. If the order price is corrected due to a technical error or other reason, the client will be notified as soon as possible. The client has the right to confirm the corrected order in writing within 3 working days. If the client does not confirm the order within this time, the order is automatically canceled. If the order has already been paid for, the full amount will be refunded to the same account from which the payment was made, no later than within 14 days.
4. Methods of Payment and Delivery
4.1. The minimum order amount is €8. If the order total is less than €8, a small order fee will be added. The amount of the small order fee equals the difference between the minimum order amount and the total price of the ordered products. This amount does not include shipping costs.
4.2. Available payment and delivery methods:
- The client picks up the goods at the RKR Seadmed OÜ store. Payment can be made via bank link, prepayment by bank transfer, credit or debit card, or by signing a Montonio installment agreement.
- Goods are delivered by DPD courier to the address specified by the client. Payment must be made 100% in advance using a bank transfer, credit or debit card, bank link, or by signing a Montonio installment agreement.
Note: When paying via bank link, be sure to click the “Return to merchant” button after completing the payment. Otherwise, the payment confirmation may not reach us, and your order processing may be delayed.
Payments can be made using the payment methods provided by Montonio. Current payment options are available on Montonio’s website: https://montonio.com.
4.3. Payment is processed in the secure environment of Montonio Finance OÜ – the seller does not have access to the client’s bank or credit card information. The contract becomes effective once the payment has been received in RKR Seadmed OÜ’s bank account.
5. Availability of Goods
5.1. If the ordered goods are in stock, they are usually delivered to the client’s specified address within 3 working days from the conclusion of the sales contract. If delivery is more complex or the goods need to be ordered, the client will be informed as soon as possible.
In exceptional cases, RKR reserves the right to deliver the goods within 30 calendar days.
5.2. RKR reserves the right to deliver goods within 30 calendar days in exceptional circumstances.
5.3. When the goods are ready for pickup, the client will be notified via email or phone. The client is obligated to collect the goods within 30 calendar days from the notification.
If the client does not collect the goods within this time and has not contacted RKR Seadmed OÜ, the order is considered canceled. In such cases, the order will be canceled and, if payment has been made, the purchase amount will be refunded immediately, but no later than within 14 calendar days to the same account from which the payment was made.
6. Client’s Right to Withdraw from the Order
6.1. The right of withdrawal does not apply if the buyer is a legal entity.
6.2. A natural person has the right to withdraw from the purchase within 14 days from receiving the goods. According to VÕS § 53 lg 4, the consumer does not have the right to return goods that cannot be returned due to their nature (e.g., software, custom orders, etc.).
6.3. To withdraw, the client must fill out the return form available in the footer of rkrseadmed.ee and return the goods.
6.4. RKR Seadmed OÜ is responsible for the preservation and damage of the goods only if the transport is arranged by the seller. If the client chooses a delivery method arranged by RKR, RKR is responsible for the goods until they are handed over to the client. From the moment of receipt, the risk of accidental loss or damage transfers to the client.
6.5. Custom-made products cannot be returned.
6.6. RKR will refund the money within 14 days from the submission of the withdrawal request, provided the goods have been returned or their shipment has been proven.
6.7. The client bears the cost of returning the goods.
8. Right to Submit Complaints
8.1. Complaints can be submitted in accordance with the Law of Obligations Act (VÕS).
8.2. A purchase invoice is required to submit a complaint.
8.3. Complaints are not valid if the product has been misused or worn out.
8.4. Products marked as “defective,” “used,” etc., are not eligible for complaints if this was previously disclosed.
8.5. The complaint handling period is up to 30 days. For some products, it is recommended to contact the warranty partner directly.
9. Reservation of Ownership
9.1. Until the goods are fully paid for, they remain the property of RKR.
10. Collection and Use of Personal Data
10.1. RKR Seadmed OÜ is committed to protecting the privacy of clients and users. The privacy policy covers the collection, use, disclosure, transfer, and storage of client data in accordance with EU and Estonian laws.
10.2. Personal data is collected with the client’s consent, for example, when submitting contact information, placing an order, using cookies, or applying for installment payments.
10.3. The collected data is used for sending newsletters, fulfilling orders, and customer service. If necessary, data may be shared with third parties (e.g., payment or installment service providers) who are obligated to keep the data confidential.
10.4. RKR implements all necessary security measures to protect personal data.
10.5. RKR may use personal data to protect its rights and share it with third parties if necessary.
10.6. All personal data is treated as confidential.
10.7. RKR reserves the right to amend the privacy policy to ensure compliance with applicable laws or changes in business operations. Clients will be notified of significant changes via the RKR website and, if necessary, by email. Changes take effect upon publication on the website unless otherwise stated. 11. Changes to Terms and Price List
11.1. RKR has the right to change the terms and price list.
11.2. Changes will be announced on the website and take effect upon publication.
11.3. If an order is placed before the changes take effect, the terms valid at the time of the order apply.
12. Supervision and Dispute Resolution
12.1. Contracts are supervised by the Consumer Disputes Committee operating under the Consumer Protection Board.
12.2. Clients may also submit complaints via the European Union’s ODR platform: http://ec.europa.eu/odr.
13. Consent to Use of Cookies
13.1. RKR uses cookies for website functionality and to improve user experience.
13.2. Currently, users can choose to accept or decline all cookies. Detailed selection of cookie types is not yet available; this functionality is under development. If the user declines cookies, only essential cookies necessary for the website to function will be stored.
13.3. If you wish to restrict or delete cookies, you can do so in your browser settings. Please note that rejecting some cookies may limit the full functionality of the online store.
14. Final Provisions
14.1. The laws of the Republic of Estonia apply to these terms and contracts.
14.2. If any provision is found to be invalid, it does not affect the validity of the remaining terms. The invalid provision will be replaced with a lawful and economically similar provision.
14.3. The terms remain accessible on the website www.rkrseadmed.ee after the conclusion of the sales contract.
